This is the privacy notice containing the terms and conditions under which COLDWELL BANKER AFFILIATES DE MÉXICO, S.A. DE C.V. (COLDWELL BANKER) as the responsible party with its address at Pedregal 24, 6th floor, office 601 B, Colonia Molino del Rey, Alcaldía Miguel Hidalgo, C.P. 11040, in Mexico City, together with its representatives, will process the personal data that you provide to COLDWELL BANKER as the owner (Holder) with respect to your interest in knowing about the Coldwell Banker franchise, learning about the properties that are promoted, or your desire to contact officials or representatives of COLDWELL BANKER.



In this regard, in accordance with the provisions of the Federal Law on the Protection of Personal Data Held by Private Parties (the "LFPDP"), its Regulations, and other related secondary provisions, we inform you that the personal data that you provide or have provided to us will be treated strictly privately, securely, and confidentially, so that the obtaining, processing, transfer, and exercise of the rights derived from such personal data is done through adequate, legitimate, and lawful use, permanently safeguarding the principles of legality, consent, quality, information, proportionality, responsibility, loyalty, and purpose.



As the Holder, you are informed that your personal data that you provide or share will be protected through the use, application, and maintenance of the technical, physical, and administrative security systems and measures that COLDWELL BANKER has for such purposes.



Terms that are not specifically defined in this Privacy Notice will have the meaning attributed to them in the LFPDP.



HOLDER'S CONSENT. For the purposes of the LFPDP, the Holder states that this Notice has been provided to him/her by the responsible party, and declares that he/she has read, understood, and accepted the terms set forth in this Notice, and grants his/her consent regarding the processing of his/her personal data, so that COLDWELL BANKER and/or its processors may use the personal data for the purposes mentioned below.



PERSONAL DATA THAT WE COLLECT. COLDWELL BANKER may collect the following personal data, among others, without limitation:



  1. Full name

  2. Age

  3. Email address

  4. Phone number

  5. Gender

  6. Marital status

  7. Number of children


These data will be used solely and exclusively for the following purposes:



  1. To provide information to the Holder.

  2. To provide assistance to the Holder.

  3. Market research, statistics, and internal reports.

  4. Communications related to the franchise application and/or its operation.

  5. Any other analogous or compatible purpose with the above.


PROCEDURE TO EXERCISE ARCO RIGHTS AND WITHDRAW CONSENT. The Holder has the right at all times to access, rectify, and cancel his/her data (subject to the provisions of Article 26 of the LFPDP), as well as to object to the processing thereof or revoke the consent provided for that purpose by submitting a request with the following information and documentation:



  1. Holder's name and address or other means to communicate the response to his/her request;

  2. The documents that prove his/her identity (official identification and public deed stating the power in the case of legal entities);

  3. A clear and precise description of the personal data with respect to which he/she seeks to exercise any of the ARCO Rights;

  4. Any other element or document that facilitates the location of the Holder's personal data.


In the case of requests for rectification of personal data, the respective owner must also indicate the modifications to be made and provide the documentation that supports their request.



For the reception, registration, attention, and response to requests to exercise their ARCO Rights and other rights provided in the LFPDP, we make available the following email: Recepción CB



In the event that the information provided in your request is incorrect or insufficient, or the corresponding accreditation documents are not provided, we may request, within five business days following receipt of the request, that you provide the necessary elements or documents to process it. The owner will have ten business days to respond to the request, counted from the day following the day they received it. If no response is given within this period, the corresponding request will be deemed not presented.



In the event that the information provided in your request is incorrect or insufficient, or the corresponding accreditation documents are not provided, we may request, within five business days following receipt of the request, that you provide the necessary elements or documents to process it. The owner will have ten business days to respond to the request, counted from the day following the day they received it. If no response is given within this period, the corresponding request will be deemed not presented.



COLDWELL BANKER or its representatives will respond to the respective owner within a maximum period of twenty business days, counted from the date the request was received, so that, if it is appropriate, the responsible party can implement it within fifteen business days following the communication of the response. In all cases, the response will be given through the same means by which the request was submitted, or in the case of any other means agreed upon with the owner. The aforementioned deadlines may be extended in accordance with the LFPDP.



LIMITATION OF USE AND DISCLOSURE OF INFORMATION. The responsible party and/or its representatives will keep the personal data of the owner for as long as necessary to process their requests for information, products, and/or services, as well as to maintain accounting, financial, and auditing records in accordance with the LFPDP and current commercial, tax, and administrative legislation. In addition, they will control the disclosure of such data or sharing of information with their business partners. The collected personal data will be protected by appropriate administrative, technical, and physical security measures against damage, loss, alteration, destruction, or unauthorized use, access, or treatment, in accordance with the provisions of the LFPDP and other applicable legislation. However, notwithstanding the above, COLDWELL BANKER does not guarantee that unauthorized third parties will not illegally access the owners' or the responsible party's physical or logical systems or the electronic documents and files stored on their systems. Consequently, COLDWELL BANKER will not be responsible in any case for the damages and harms that may arise from such unauthorized access, for which COLDWELL BANKER will inform the owner.



This privacy notice may be modified by COLDWELL BANKER, and such modifications will be promptly notified through email, telephone, or any other means of communication that COLDWELL BANKER determines for this purpose, or simply through the update of this notice.
